Thailand Introduces Amended Trademark Law, Advises Trademark Specialist BSA Law

1888PressRelease - Thai Law Firm BSA Law advises there have been amendments made to Thailand's trademark law, which came into effect on 28 July 2016.
The Act sees changes to the trademark application procedure, improved prosecution and protection. Director-general of the Department of Intellectual Property, Nantawan Sakuntanak, said the amended trademark law was now in force.
The Act eliminates the current requirement of filing one application in one class of goods/services, meaning it will be possible to file multi-class applications.
Another significant element of the amended law, explained Nantawan, relates to the elimination of deception in the goods market. Any person found counterfeiting materials bearing the trademark of another for the packaging of his own goods in order to misinform the public in to believing that the said goods are coming from the company whom had its trademark infringed upon, will be liable to a four year prison term or a fine not exceeding Bt400,000 or both.
In the past, Nantawan said, there had been rampant use of registered trademark packages of brand name goods to package fake goods, in particular liquor, lubricant oils, shampoo and medicines. This practice was also considered hazardous to consumers' health.
A new addition by the Act is the protection of sound marks. With goods and services being capable to distinction by sonic means, sound marks is seen as a natural addition to the categories of marks protected under trademark law.
